  • All communications, negotiations, and agreements made with other users
  • Ensuring that your listings do not violate any laws, regulations, or third-party rights
  • Maintaining accurate and up-to-date contact information
  • Removing or updating listings when vehicles are sold or no longer available
  • Complying with all tax obligations related to your transactions

TRUCKSELLER BEARS ABSOLUTELY NO RESPONSIBILITY for false, misleading, inaccurate, fraudulent, or incomplete information entered by users. We do not verify, validate, or investigate user-submitted content.

3. Platform Role

Truckseller operates exclusively as a NEUTRAL THIRD-PARTY PLATFORM and classified advertising service. We facilitate connections between buyers and sellers but are NOT a party to any transactions. Specifically:

  • We do NOT own, lease, sell, or have possession of any vehicles, equipment, or items listed on the platform
  • We do NOT inspect, verify, appraise, or evaluate any vehicles or their condition
  • We do NOT guarantee the accuracy of listings, descriptions, photographs, or pricing
  • We do NOT endorse, recommend, or vouch for any users, dealers, or listings
  • We do NOT participate in negotiations, pricing, or terms of sale
  • We do NOT handle payments, financing, shipping, or delivery arrangements
  • We are NOT responsible for the conduct, actions, or omissions of any users
  • All transactions, agreements, contracts, and interactions occur DIRECTLY AND EXCLUSIVELY between users

4. Account Security

You are fully responsible for maintaining the security and confidentiality of your account credentials, including your username, password, and any other authentication methods. You agree to:

  • Create a strong, unique password that is not used for other services
  • Keep your password confidential and not share it with anyone
  • Notify us immediately if you suspect any unauthorized access to your account
  • Log out of your account after each session, especially on shared or public devices
  • Accept full responsibility for all activities that occur under your account
  • Not allow others to use your account under any circumstances

YOU AGREE NOT TO HOLD TRUCKSELLER LIABLE for any unauthorized access, account hijacking, identity theft, data loss, or security breaches resulting from your use of the platform, failure to maintain account security, or third-party actions beyond our control.

5. Prohibited Conduct

You expressly agree NOT to engage in any of the following prohibited activities:

  • Impersonating any person, entity, or Truckseller representative
  • Creating multiple accounts to circumvent restrictions or manipulate the platform
  • Using automated systems, bots, scrapers, or scripts to access the platform
  • Attempting to hack, breach security, or gain unauthorized access to our systems
  • Transmitting viruses, malware, or any harmful code
  • Harassing, threatening, defaming, or abusing other users
  • Posting content that is illegal, obscene, offensive, or violates intellectual property rights
  • Engaging in price manipulation, bid rigging, or market manipulation
  • Using the platform for money laundering, fraud, or any illegal activities
  • Collecting user information without consent (data harvesting)
  • Interfering with the proper functioning of the platform
  • Circumventing or attempting to bypass any security measures
  • Using the platform to distribute spam or unsolicited commercial messages

Violation of these prohibitions may result in immediate account termination, legal action, and reporting to law enforcement authorities.

Upon termination, your right to use the platform ceases immediately. We may delete all your data, listings, and account information without liability.

2. Fraud and Scams

  • Scams, phishing attempts, or identity theft
  • Stolen vehicles being advertised for sale
  • Fake payment schemes or advance fee fraud

  • Counterfeit cashier's checks or money orders
  • Bait-and-switch tactics
  • Any financial losses resulting from fraud

YOU MUST EXERCISE EXTREME CAUTION when dealing with other users. We recommend:

  • Meeting sellers in person at safe, public locations
  • Thoroughly inspecting vehicles before purchase
  • Verifying ownership and title documentation
  • Never wiring money or sending payment before seeing the vehicle
  • Being skeptical of deals that seem "too good to be true"
  • Conducting background checks on sellers when possible
  • Using secure, traceable payment methods

3. False Listings

Despite our efforts to maintain quality, false or misleading listings may appear on the platform. TRUCKSELLER IS NOT RESPONSIBLE FOR:

  • Inaccurate vehicle descriptions or specifications
  • Misrepresented condition or damage history
  • Undisclosed mechanical issues or defects
  • Odometer fraud or mileage discrepancies
  • False accident or repair history
  • Misrepresented ownership or salvage titles
  • Deceptive photography or image manipulation
  • Any other misleading or false information

While we encourage users to report suspicious listings, we do NOT guarantee removal or take responsibility for content accuracy.

4. Vehicle Condition

ALL VEHICLES ARE LISTED "AS-IS, WHERE-IS" WITH ALL FAULTS.

  • Truckseller provides NO WARRANTIES of any kind, express or implied
  • We make NO REPRESENTATIONS about vehicle condition, quality, safety, or reliability
  • We do NOT inspect, test, or verify any vehicles
  • Sellers may not disclose all defects or issues
  • Photographs may not reflect current condition
  • Mechanical issues may exist that are not apparent
  • Safety recalls or manufacturer defects may exist

IT IS YOUR RESPONSIBILITY to conduct thorough inspections, obtain independent mechanic evaluations, review vehicle history reports (Carfax, AutoCheck), and verify all claims before purchasing.

5. Transactions

Truckseller IS NOT A PARTY TO ANY TRANSACTIONS and bears NO LIABILITY for:

  • Failed, delayed, or problematic transactions
  • Disputes over price, terms, or conditions
  • Non-payment or payment issues
  • Delivery problems or shipping damage
  • Title transfer complications
  • Sales tax, registration, or DMV issues
  • Warranty claims or post-sale problems
  • Buyer's remorse or dissatisfaction
  • Contract breaches or disagreements
  • Any other transaction-related issues

All transactions are conducted EXCLUSIVELY BETWEEN BUYER AND SELLER. Any contracts, agreements, or arrangements are between those parties only.

  • Does NOT endorse, control, or take responsibility for third-party content
  • Is NOT liable for third-party websites' accuracy, legality, or safety

7. Force Majeure

1. Hacking & Cyber Attacks

TRUCKSELLER IS NOT LIABLE for damages, losses, or breaches resulting from:

  • Hacking attempts or successful security breaches
  • Distributed Denial of Service (DDoS) attacks
  • SQL injection or code injection attacks
  • Cross-site scripting (XSS) vulnerabilities

2. Impersonation

  • May suspend or terminate the fraudulent account within 48-72 hours
  • May report to law enforcement if warranted

3. Spam & Abuse

  • Harassing, threatening, or abusing other users

Violations may result in immediate account termination without warning.

YOU REPRESENT AND WARRANT that:

  • You own or have rights to all content you upload
  • Your content does not infringe any copyrights, trademarks, or intellectual property rights
  • You have permission to use any photographs, logos, or branded materials
  • You will not use copyrighted images without authorization

Truckseller is NOT responsible for copyright infringement by users. If you believe your copyright has been violated, contact us with:

  • Location of the infringing content on our site
  • Your contact information
  • Statement of good faith belief that use is unauthorized

6. Illegal Activities

The platform MAY NOT BE USED FOR:

  • Money laundering or financing illegal activities
  • Fraud, forgery, or counterfeiting
  • Selling vehicles with tampered VINs or odometers
  • Tax evasion or structuring transactions to avoid reporting
  • Violating emissions or safety standards
  • Any other illegal or criminal activities

We cooperate with law enforcement and will report suspected illegal activities. Violators will be permanently banned and may face criminal prosecution.

ALL VEHICLES ARE SOLD "AS-IS, WHERE-IS" WITH ALL FAULTS. Any warranties are between buyer and seller only.

3. No Endorsement

Truckseller does NOT endorse, recommend, verify, or vouch for:

  • Any users, dealers, or businesses on the platform
  • Quality or accuracy of listings
  • Products, services, or vehicles advertised
  • Claims, representations, or promises made by users
  • Third-party services or websites linked from our platform

Presence on our platform does NOT constitute endorsement or approval.

NOTHING ON THIS SITE CONSTITUTES LEGAL, FINANCIAL, TAX, OR PROFESSIONAL ADVICE.

Indemnification

1. User Indemnification

If a claim is made against Truckseller arising from your conduct:

  • You may NOT settle claims without our written consent
  • You remain liable for all costs, damages, and expenses

3. Costs & Expenses

Your indemnification obligations include reimbursing us for:

  • All legal fees and attorney costs
  • Court filing fees and litigation expenses
  • Expert witness fees and investigation costs
  • Settlement amounts and judgments
  • Any other costs incurred defending claims against us

These obligations survive termination of your account and these Terms.

Dispute Resolution

1. User-to-User Disputes

ALL DISPUTES BETWEEN USERS MUST BE RESOLVED DIRECTLY BETWEEN THE PARTIES.

  • Truckseller is NOT a mediator, arbitrator, or dispute resolver
  • We will NOT intervene in user disputes
  • We cannot enforce agreements or contracts between users
  • We are NOT liable for any disputes, claims, or damages
  • Support staff may provide guidance but cannot resolve disputes

If you have a dispute with another user, you release Truckseller from all claims, demands, and damages arising from that dispute.

2. Arbitration

MANDATORY ARBITRATION CLAUSE: Any dispute between you and Truckseller shall be resolved through binding arbitration, NOT in court, except as noted below.

  • Arbitration will be conducted by the American Arbitration Association (AAA)
  • Governed by AAA Commercial Arbitration Rules
  • Arbitrator's decision is final and binding
  • Each party bears their own costs unless otherwise awarded
  • Arbitration location will be determined by the arbitrator

Exceptions: Either party may seek injunctive relief in court for intellectual property violations or to enforce arbitration provisions.

3. Legal Jurisdiction

These Terms and any disputes shall be governed by the laws of [INSERT YOUR STATE/COUNTRY], without regard to conflict of law principles.

  • You consent to exclusive jurisdiction in courts located in [INSERT LOCATION]
  • You waive any objections to venue or inconvenient forum

If this class action waiver is found unenforceable, the entire arbitration clause is void.

1. Test Drives

TEST DRIVES ARE CONDUCTED AT PARTICIPANTS' OWN RISK.

  • Truckseller is NOT involved in test drive arrangements
  • We are NOT LIABLE for accidents, injuries, or damages during test drives
  • Participants should verify insurance coverage before test driving
  • Sellers should verify driver's license and insurance
  • We recommend having witnesses and documentation
  • Both parties assume all risks associated with test drives

2. Vehicle Inspections

WE STRONGLY RECOMMEND PROFESSIONAL INSPECTIONS BEFORE PURCHASE.

  • Hire independent, certified mechanics to inspect vehicles
  • Obtain vehicle history reports (Carfax, AutoCheck)
  • Check for outstanding recalls or safety issues
  • Verify VIN authenticity and title status
  • Inspect for frame damage, flood damage, or salvage history

Truckseller is NOT responsible for undisclosed issues, defects, or problems discovered after purchase.

3. Payment Methods

Truckseller does NOT process payments or handle transactions. USE CAUTION:

  • Never wire money or send payment before seeing the vehicle in person
  • Beware of cashier's check scams and counterfeit money orders
  • Meet in safe, public locations for cash transactions
  • Consider using escrow services for high-value purchases
  • Verify funds have cleared before transferring title
  • Document all payments with receipts

We are NOT LIABLE for payment fraud, scams, or financial losses.

4. Shipping & Delivery

Truckseller does NOT provide shipping or delivery services. If you arrange transport:

  • Research and verify transport companies
  • Obtain proper insurance coverage
  • Inspect vehicles upon delivery before signing
  • Document condition with photographs
  • Understand who is liable for damage in transit

We are NOT RESPONSIBLE for shipping damage, delays, lost vehicles, or transport disputes.

5. Right to Remove Content

TRUCKSELLER RESERVES THE ABSOLUTE RIGHT TO:

  • Remove, edit, modify, or delete any content at any time
  • Suspend or terminate user accounts without warning
  • Refuse service to anyone for any reason
  • Change, suspend, or discontinue any aspect of the platform
  • Monitor, investigate, or review user activity

We are NOT obligated to provide reasons, explanations, or warnings before taking action. These rights are exercised at our sole discretion.

6. Fees & Changes

Currently, posting listings on Truckseller is free during our promotional period (ending July 4, 2026). However:

  • We reserve the right to introduce fees at any time
  • Fee structures may change without notice
  • Special features may require payment in the future
  • Promotional periods may end earlier than announced

Continued use after fee implementation constitutes acceptance of charges.
